These terms explain the deal between you and Marlowthorn whenever you visit this website or buy one of our printed canvas totes. They are written to be read, not skimmed past, so please take a few minutes with them.

No. 01Who runs this shop

The Marlowthorn website and online shop are operated by WINFINE INDUSTRIES (HONG KONG) LIMITED (referred to here as "Marlowthorn", "we", "us" or "our"). Our registered office is at:

Using the site or placing an order means you accept these terms along with the policies linked from them, in particular our Privacy Policy, Shipping Policy and Return & Refund Policy.

No. 02Age and eligibility

To place an order you need to be 18 or older, or to have reached the age of majority where you live, and you need to be able to form a binding contract. Anyone younger is welcome to look around, though a parent or guardian should complete any purchase.

No. 03Your account

Creating an account is entirely optional, and guest checkout works just as well. If you choose to register, keep your details accurate and your password private, and tell us promptly if you think someone else has used your login. You are responsible for orders placed through your account. We may suspend an account that is used in breach of these terms.

No. 04The totes, and a word on colour

Every Marlowthorn tote is printed canvas, and we photograph each design carefully. Even so, screens differ, and the colours you see may look a little warmer, cooler, brighter or softer than the bag in your hands. Canvas is a woven natural-feel fabric, so slight variation in weave, print placement at the seams and measurements from one bag to the next is normal and is not treated as a defect. Product descriptions are accurate to the best of our knowledge; where something important differs from what we described, our returns policy looks after you.

No. 05Prices

Prices are shown in US dollars. Each tote is currently $49.99. Shipping is added at checkout: a $7.99 flat rate, or free when your order reaches $100 or more. Import duties or local taxes charged by your country are paid by the recipient. We can change prices at any time, but the price shown when you place your order is the one you pay. If we list something at an obviously wrong price, we will contact you before shipping and you can choose to cancel for a full refund.

No. 06How an order becomes a contract

Placing an order is an offer to buy. We accept it when we email to say your tote has shipped, and that email forms the contract between us. Before then we may decline or cancel an order, for example if a design is unexpectedly unavailable, a payment raises a fraud flag, or the order appears to be for resale in bulk. If we cancel after taking payment, the full amount is refunded to your original payment method.

No. 07Paying for your order

Payment is taken at checkout through Shopify's secure checkout and its approved payment processors. You confirm that you are entitled to use the payment method you provide. We never see or store your full card number. More detail is on our Payment & Security page.

No. 08Delivery and risk

We ship worldwide with tracking. Estimated timeframes are set out in the Shipping Policy; they are estimates rather than guarantees. Responsibility for the parcel passes to you once the carrier records it as delivered to the address you gave us. Please double-check that address at checkout, because we cannot be responsible for parcels sent to an incorrect address supplied by the buyer.

No. 09Returns

You may return a tote within 30 days of delivery, including simply because you changed your mind. The process, which starts with a quick email to us, is explained in full in our Return & Refund Policy. Nothing in these terms limits any consumer rights you have by law.

No. 10Artwork, content and our trademark

The designs printed on our totes, together with the photographs, text, graphics and layout of this website, belong to Marlowthorn or to the artists who license them to us. You may not copy, reproduce, sell or adapt them for commercial use without our written permission. Buying a tote gives you the bag, not the right to reproduce its artwork.

Marlowthorn is a trademark owned and operated by WINFINE INDUSTRIES (HONG KONG) LIMITED. The name and logo may not be used in a way that suggests our endorsement or causes confusion.

No. 11Using the site fairly

• Do not use the website for any unlawful or fraudulent purpose.
• Do not attempt to break into, overload or interfere with the site or its checkout.
• Do not scrape, harvest or copy our catalogue or content in bulk by automated means.
• Do not post or send anything abusive, misleading or that infringes someone else's rights.

No. 12Links to other websites

Our pages occasionally link to services run by other companies, such as payment providers or parcel trackers. We do not control those services and are not responsible for their content or how they handle information, so please read their own terms.

No. 13Disclaimers

We work hard to keep the site accurate and running smoothly, but it is provided "as is" and "as available". To the fullest extent the law allows, we make no promise that it will always be uninterrupted or free of errors, and we give no warranties beyond those set out in these terms and those the law does not allow us to exclude.

No. 14Limits on our liability

As far as the law permits, Marlowthorn will not be liable for indirect, incidental or consequential loss, or for lost profits or data, arising from your use of the site or our products. Our total liability for any claim connected with an order is capped at the amount you paid for that order. None of this limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.

No. 15Indemnity

If you breach these terms or misuse the website, and a third party makes a claim against us as a result, you agree to cover the reasonable losses, costs and legal fees we incur because of it.

No. 16Governing law

These terms, and any dispute arising from them, are governed by the laws of Hong Kong SAR, and the courts of Hong Kong SAR have jurisdiction. If you are a consumer, you also keep the protection of any mandatory rules of the country where you live.

No. 17When these terms change

We may revise these terms from time to time, and the date at the top of this page will show when. The version in force when you place an order is the one that applies to it.

No. 18Severability and entire agreement

If a court finds any part of these terms unenforceable, the rest remains in effect. These terms, with the policies they refer to, make up the whole agreement between you and Marlowthorn about your use of the site and your purchases, and they replace anything said earlier. A delay on our part in enforcing any of these terms does not mean we have waived it.
